1. Acceptance of Terms

By accessing the website at mobilally.com or purchasing our hardware products (including ALLY Mesh, ALLY Vault, and MCM Series modules), you agree to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

2. Kickstarter & Pre-Orders

2.1 Crowdfunding Nature: Products listed as "Kickstarter" or "Pre-Order" (specifically the ALLY Mesh Q2 2026 batch) are currently in the final development or manufacturing phase. Delivery dates are estimates and are subject to change due to supply chain variables.

2.2 Refunds: Pre-orders may be cancelled for a full refund at any time prior to the "Locked for Shipping" notification. Once an order is locked or shipped, our standard Return Policy applies.

3. Defense & ITAR Compliance

3.1 Export Controls: Certain MobilALLY products, specifically the MCM-300 series and above, may be subject to the International Traffic in Arms Regulations (ITAR) or the Export Administration Regulations (EAR). You agree not to export, re-export, or transfer these products to any prohibited country, entity, or person without the necessary government authorization.

3.2 End Use: You certify that you will not use our products for any purposes prohibited by United States law, including the development, design, manufacture, or production of nuclear, missile, or chemical/biological weapons.

4. Use License & Restrictions

Permission is granted to use the ALLY Mesh hardware and accompanying software for personal or commercial communication. However, you may not:

• Attempt to reverse engineer the MCM Protocol or physical security layers (except as permitted by applicable law).
• Use the hardware to interfere with critical infrastructure or emergency communications.
• Resell the hardware to entities on the U.S. Consolidated Screening List.

5. Disclaimer

The materials and hardware are provided on an 'as is' basis. MobilALLY LLC makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

6. Limitation of Liability

In no event shall MobilALLY LLC or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on MobilALLY LLC's website or hardware, even if MobilALLY LLC or a MobilALLY LLC authorized representative has been notified orally or in writing of the possibility of such damage.
